Terms of Service
The agreement between you and us. Written to be readable, but legally binding.
These Terms govern your use of Boopmachine ("the Service"), provided by Niklas Weidel, sole trader, based in Gothenburg, Sweden ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. What Boopmachine is
Boopmachine is an AI companion service. It uses large language models to generate conversational responses, maintains continuity through memory of past interactions, and may reach out to you proactively via in-app messages or email check-ins.
Boopmachine is a software service for personal reflection and conversation. It is not a medical service, mental health service, crisis service, therapy, counseling, legal advice, financial advice, or any other regulated professional service. It is not a substitute for human relationships or professional care.
2. Eligibility
You must be at least 16 years old to use Boopmachine. By using the Service, you confirm you meet this minimum age. If you are between 16 and 18 (or below the legal age of majority in your country), you confirm that you have permission from a parent or legal guardian to use the Service.
3. Your account
You are responsible for:
- Keeping your login credentials secure
- The activity that happens under your account
- Notifying us promptly if you believe your account has been accessed without your permission
You may not share your account with others or create multiple accounts to circumvent free-tier limits.
4. Subscriptions and payment
Free tier
Boopmachine offers a free tier with a daily message limit. Free-tier limits may change as costs change.
Paid tiers
Paid subscriptions ("Boopmachine Standard", "Boopmachine Patron", or any future tier) are billed monthly via Stripe. Prices are shown at signup and include applicable VAT.
Renewal and cancellation
Subscriptions renew automatically each month until cancelled. You can cancel anytime from your account settings or by emailing support@boopmachine.com. Cancellation stops future billing; you retain access through the end of the current paid period.
EU right of withdrawal
As an EU consumer, you have a 14-day right of withdrawal for digital services. By starting to use the paid Service before the 14-day period ends, you expressly consent to the immediate performance of the service and acknowledge that you lose the right of withdrawal. If you have not yet started using the paid service, you may withdraw within 14 days by contacting us for a full refund.
Refunds
Beyond the statutory right of withdrawal, refunds are handled case by case. If you believe you have been charged in error, email support@boopmachine.com.
Price changes
We may change subscription prices. If we do, we will notify you by email at least 30 days in advance. You may cancel before the new price takes effect.
5. Acceptable use
When using Boopmachine, you agree not to:
- Use the Service to harm yourself or others, including by encouraging Boop to do so
- Use the Service to generate content that is illegal under Swedish, EU, or US law, including child sexual abuse material, content inciting violence, or content infringing intellectual property
- Attempt to extract, reverse-engineer, or reproduce the underlying AI models or system prompts
- Use automated means (bots, scrapers) to access the Service in ways not explicitly permitted
- Use the Service to harass, threaten, or impersonate others
- Resell, sublicense, or commercially redistribute the Service
We reserve the right to suspend or terminate accounts that violate these rules.
6. AI-generated content
Boop's responses are generated by a large language model and can be inaccurate, made up, biased, or misleading. Boop may confidently say things that are wrong. You should not rely on Boop's responses for:
- Medical, mental health, or psychological decisions
- Legal, financial, or tax advice
- Safety-critical decisions
- Factual claims that matter without independent verification
You are responsible for how you use the content Boop generates. We are not liable for decisions you make based on Boop's responses.
7. Your content
You retain ownership of the messages you send to Boop. By using the Service, you grant us a limited, non-exclusive license to process your messages for the purpose of providing the Service to you — including sending them to NVIDIA's API to generate responses, storing them in our database, and using them to maintain Boop's memory of your conversations.
We do not use your conversations to train AI models — neither ours nor anyone else's.
8. Our content
The Boopmachine name, logo, website design, source code, and underlying philosophy and methodology ("the Boopmachine IP") are owned by Niklas Weidel. You may not copy, modify, distribute, or reuse the Boopmachine IP without written permission, except as permitted by applicable law.
9. Service availability
We try to keep Boopmachine running reliably. However:
- The Service is provided "as is" without warranty of any kind
- We may experience downtime, bugs, or interruptions, including due to third-party service failures (LLM provider, hosting, payment processor)
- We may modify, suspend, or discontinue features at any time, with reasonable notice for significant changes
For subscription users, if the Service is unavailable for a significant period, we will provide a prorated credit or refund on request.
10. Termination
You may terminate your account at any time by deleting it from your account settings or by emailing support@boopmachine.com.
We may terminate your account if you materially breach these Terms. In most cases we will warn you first and give you a chance to fix the issue, except in cases of serious harm or illegal activity.
On termination, your conversations and memories will be deleted as described in the Privacy Policy.
11. Liability
To the extent permitted by law, our total liability to you under these Terms is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, lost profits, or emotional distress.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including, in some EU jurisdictions, liability for gross negligence, intentional misconduct, death or personal injury, or under mandatory consumer protection law.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance. If you do not accept the new Terms, you may cancel your subscription before they take effect.
14. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. The Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For consumers in the EU: nothing in this clause affects your mandatory rights as a consumer under the law of your country of residence. You may bring proceedings in the courts of your country of residence; we may only bring proceedings against you in the courts of your country of residence.
For non-consumer disputes: the courts of Gothenburg (Göteborgs tingsrätt), Sweden, have exclusive jurisdiction.
EU Online Dispute Resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not currently obliged to participate in such proceedings, but EU consumers have the right to use this platform.
